7. How and Where Do We Store Your Data?

7.1         We only keep your personal data for as long as We need to in order to use it as described above in section 6, and/or for as long as We have your permission to keep it.
7.2         Some data may be stored temporarily by Our hosting provider, Scala Hosting LLC. Please review their Privacy Policy for more details.
7.3 Emails sent to us directly are stored by ProtonMail, which is an End to End Encrypted email provider. If you email Us from an end to end encrypted email address, your email contents will only be accessible to Our staff for the purposes of Our Work together.
7.4         Steps We take to secure and protect your data include:

  • We only email you directly or use BCC (blank carbon copy) which keeps your email address invisible if emailing to multiple recipients.
  • Our contact forms forward your messages to Our zero-knowledge email provider. Though contact form submissions (and emails from non-E2EE email addresses) are not end to end encrypted, once they are received by Us, after being scanned for spam by ProtonMail, they are stored using at-rest encryption, with the password only accessible to Our staff.
  • Regardless of these precautions, we caution our clients to never include any Protected Health Information through any form of electronic communications, except for when using our HIPAA compliant client portal.

8. Confidentiality and Therapy Records

8.1 All clinicians at Queer Therapy NYC adhere to professional confidentiality standards and applicable legal and ethical guidelines. What you share in therapy is confidential, except in cases where:

  • There is suspected abuse or neglect of a child, elder, or vulnerable adult
  • You express intent to harm yourself or others
  • Records are subpoenaed by a court of law

8.2 Therapy records are securely stored using TheraNest, a HIPAA-compliant electronic health record system. Your therapist will review confidentiality and its limits with you during the intake process.
